A Rare Scottish Decision on Director Liability For Copyright Infringement

Naxos Rights International Ltd v Project Management (Borders) Ltd & Salmon [2012] CSOH 158

Last month, Lord Glennie sitting in the Outer House (a court of first instance) of the Court of Session, Edinburgh, issued an opinion that the director of a company selling copyrighted materials illegally was also liable for the infringement.  The opinion is illustrative of an increasing trend to lift the corporate veil across many areas of liability, especially for IP infringement.
