The conference will cover:
- Managing environmental compliance risks offshore - Judicial scrutiny of licensing and planning consent decisions could impact the rules for granting exploration licences and development consents. Increased environmental enforcement is also likely where regulators are already under pressure. In this session we will cover the current state of play on the judicial challenges, key trends in environmental enforcement and discuss practical tips for managing risks and ensuring compliance.
- Termination provisions and the current legal landscape - Termination provisions are increasingly in the spotlight following a number of high-profile recent examples in the energy and infrastructure space. In this session, we will review market trends and current case law around termination provisions, and factors to consider in negotiating these provisions for developers and contractors alike.
- Immigration & visas: changes, crackdowns and compliance - In recent months we have seen a significant change in approach from the Home Office, who are now taking a very robust approach to immigration compliance. This is especially the case for employers that hold sponsor licences to employ or sponsor international staff. This session will cover what organisations need to know about the recent change in approach, and how to review processes and systems to ensure ongoing compliance with your sponsor management obligations.
- Limitation of liability clauses - the potential for challenge in energy service contracts. Contractors may be confident that their maximum exposure will be capped in the event of a breach of contract. This session will discuss whether that position is justified and what factors the prudent drafter should bear in mind.
- Managing toxic workplaces - Employers are facing an increasing number of grievances and tribunal claims from employees complaining of toxic workplaces from bullying and harassment to discrimination and whistleblowing. These complaints are difficult to manage and come with high financial, cultural and reputational costs. With employers under a duty to prevent sexual harassment and navigate a complex legal framework, together with a raft of additional legislation coming into force under the upcoming Employment Rights Bill, legal and compliance teams should be thinking ahead. This session will focus on how to investigate and manage complaints, what pitfalls to look out for and tips to prevent these claims in the first place.
