If you were ever in any doubt about the importance of Scotch whisky to our national economy, recent figures released by HMRC reveal that it makes up three-quarters of Scottish produce sold around the world.

As Scotland’s overseas food and drink exports reached a record high of £6.3 billion, our national drink accounted for 75 per cent of the total food and drink exports, up by £338 million to £4.7bn (a rise of 7.8 per cent on the previous year).

One of the things that English based IP lawyers find most surprising about the court system in Scotland is that we have no equivalent to discovery. In this jurisdiction there is no blanket obligation on a party to a litigation, to disclose documents to their opponent.
