The Wait Is Over... New EU General Data Protection Regulation Formally Adopted

We have been talking and speculating about upcoming data protection reforms for years - but now they are finally here!  After over four years of arduous negotiations through the European institutions, the text of the EU General Data Protection Regulation (GDPR) was finalised on 8 April and formally adopted by the European Parliament last Thursday.

Political agreement on the GDPR was reached just before Christmas last year, and over the last few months we have been getting to grips with the main changes.  Now the legislation has been formally adopted, we have a clearer understanding of when it comes into force and – most importantly – how long we have to get ready for it:

  • In the next few weeks, the GDPR will be published in the Official Journal of the European Union – which triggers the timeline for implementation.
  • 20 days after it has been published – expected to be around July – the GDPR will come into force.
  • 2 years after the GDPR has come into force – around July 2018 – it will be directly applicable in all Member States of the EU.

Two years may seem like a long way off, but now is the time to start planning – as highlighted in our previous blog.  The reforms brought in by the GDPR are far-reaching, and the consequences for getting it wrong will be severe.
